These Terms and Conditions (“Terms”) constitute a legal agreement between you (referred to as “User,” “You,” or “Your”) and [Oneparcel] (referred to as “We,” “Us,” or “Our”) regarding your use of the www.oneparcel.in website or Oneparcel App and any associated services (collectively referred to as the “Website”).

1. Acceptance of Terms

1.1. Access to and use of this Website and the services available through this Website are subject to the following terms, conditions, and notices. By using the Website, you are agreeing to all of the Terms as may be updated by us from time to time.

1.2. Users who do not agree with these Terms must refrain from using our Website.

2. User Responsibilities

2.1. Parcel Contents: Users are accountable for the contents of their parcels. They must ensure contents adhere to all applicable laws, regulations, and our parcel content guidelines.

2.2. Restricted Items: We maintain a list of items that are prohibited for shipping. Users are forbidden from sending these items and must consult our restricted list prior to booking.

2.3. Accuracy: Users are obligated to provide authentic and up-to-date information when utilizing our service.

3. Parcel Inspections

3.1. We reserve the right to conduct, at our discretion, random inspections of parcels to ensure compliance with our guidelines and legal regulations.

3.2. Users who refuse inspections may have their parcels returned or service denied.

4. Privacy and Personal Information

4.1. Our Privacy Policy, incorporated by reference in these Terms, describes how we manage, process, and store personal data provided by Users during their use of the Website.

5. Reporting and Compliance

5.1. Users and our affiliates are encouraged to report suspicious activities or parcels. We work closely with regulatory and law enforcement agencies to ensure the safety and compliance of our operations.

5.2. We hold the right to share user details with law enforcement, in line with our Privacy Policy, should illegal activities be detected or suspected.

6. Liability and Indemnification

6.1. Users accept all risks associated with their parcels. We do not assume liability for loss, damage, or legal repercussions stemming from parcels.

6.2. Users agree to indemnify and hold harmless Oneparcel, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, including attorney fees, arising out of their misuse of our services or violation of these Terms.

7. Amendments to Terms

7.1. We reserve the right to amend, modify, or replace these Terms at any moment. It is the User’s responsibility to check these Terms regularly. Continued use of the Website post any changes equates to acceptance of the modified Terms.

8. Governing Law and Jurisdiction

8.1. These Terms shall be governed by and construed in accordance with the laws of UT J&K. Any disputes or claims will be settled in the competent courts of UT J&K.

Service Agreement

TERMS &
CONDITIONS.

Please read these terms carefully. By using our services, you agree to be bound by the conditions outlined below.

1. General Scope

Oneparcel ("We", "Us", "Our") acts as a logistics aggregator connecting shippers ("User", "You") with third-party courier companies (FedEx, Delhivery, BlueDart, etc.). We facilitate the booking, tracking, and management of shipments but do not physically transport the goods ourselves. The final delivery is subject to the terms of the respective carrier.

2. Booking & Pickup

2.1 Accuracy of Information

You agree to provide accurate details regarding the pickup address, delivery address, phone numbers, and contents of the package. Any delay or return caused by incorrect information is your sole responsibility.

2.2 Packaging Responsibility

It is the shipper's responsibility to ensure the item is packed securely. We are not liable for damage caused by improper packaging (e.g., sending glass without bubble wrap). We recommend using our premium packaging service for fragile items.

3. Weight & Billing Discrepancies

Shipping charges are calculated based on the higher of Actual Weight or Volumetric Weight.

Chargeable Weight & CFT Policy

The volumetric divisor (standard is 5000) may vary as per the CFT (Cubic Feet) standard of the respective carrier company. Since all logistics partners (FedEx, Delhivery, BlueDart, etc.) operate on different standards, the final chargeable weight will be calculated based on the specific carrier's formula applicable at the time of booking.

If the courier finds the weight to be higher than declared by you, the difference will be debited from your wallet. We reserve the right to hold shipments until weight discrepancies are cleared.

4. Liability & Insurance

4.1 Limited Liability Clause

As an aggregator, Oneparcel's liability is strictly limited. In the event of loss or damage, the carrier's liability clause applies. Typically, this is limited to ₹2,000 or the freight value, whichever is lower, unless specific insurance is purchased at the time of booking.

4.2 No Consequential Damages

We are not liable for any indirect or consequential loss (e.g., loss of profit, loss of market, or penalty fees) arising from delays, mis-delivery, or loss of shipment.

5. Right to Inspect

Security & Compliance Check

Oneparcel and its affiliated carrier partners reserve the right to open and inspect any shipment at any time for security, customs compliance, or verification of contents without prior notice to the shipper.

If a shipment is found to contain prohibited items (e.g., flammables, drugs, batteries without declaration), misdeclared goods, or dangerous materials:

  • The shipment may be seized, destroyed, or handed over to government authorities.
  • The shipper will be liable for any fines, penalties, or legal action resulting from such violations.
  • No refund of shipping charges will be provided.

6. RTO (Return to Origin)

If a shipment cannot be delivered due to incorrect address, customer refusal, or unavailability:

  • The shipment will be returned to the origin (RTO).
  • RTO charges (equivalent to the forward shipping cost) will be applicable and deducted from your account.

7. Governing Law & Jurisdiction

These terms shall be governed by the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Jammu, J&K.
